Definitions

"YancyPM" refers to pm.yancy.org.

"The Admin" refers to Richard Yancy, the owner and administrator of the YancyPM Website .

"Advertiser" means the party placing an order with the Admin for an Advertisement and includes the Advertiser's advertising agency or media buyer.

"Impression" refers to the succesfull loading of the page on which the banner advertisment is displayed.

"Click" refers to a mouse click on a banner that activates the banner's link.

Banner ads accepted for the YancyPM Website are subject to The Advertiser?€™s agreement to all Terms and Conditions contained herein.

Terms of acceptance

All banner advertisements will be reviewed by the Admin and are subject to approval by the Admin. The Admin reserves the right to refuse or cancel any advertising at any time for any reason.

Warranty and indemnification

The Advertiser represents and warrants that all rights, including but not limited to any copyrights, patent rights or other intellectual property rights, arising out of, or relating to, advertising materials are either owned by the advertiser or the advertiser has full authority from each owner of each such right to allow the Admin to transmit such advertising materials on the the YancyPM Website. Any advertising agency through whom the Advertiser places advertising through, hereby agrees to defend, indemnify, and hold the Admin harmless from any and all claims, damages and expenses of any nature arising out of or relating to any breech of foregoing warranties or the transmission of the advertising materials, including but not limited to claims based on invasion of privacy, right of publicity, libel, copyright or trademark infringement, or other causes of action.

Limitation of liability

The Admin expressly disclaims any and all warranties, whether express or implied, including, without limitation, any implied warranties of merchantability or fitness for a particular purpose with regard to its advertising services, including any and all oral and written information communicated about such services. To the maximum extent permitted by applicable law, in no event shall the Admin be liable for any consequential, incidental, direct, indirect, special, punitive, or other damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or other pecuniary loss) arising out of this agreement, even if the Admin has been advised of the possibility of such damages.

Terms of payment

1. Payment is due in full from receipt of invoice or payment link. No advertisments will be published until payment has been received. Advertisments will be published within 48 hours of payment confirmation.
2. Banners must be no bigger than 600px wide by 120px high and must be a gif, png or jpeg image.
3. Payment is made in purchase of an advertising period. The banner will be removed from the YancyPM Webiste once the purchased period has ended. The banner will be re-activated once a further advertising period has been purchased or otherwise removed completely.
4. No refunds will be offered under any circumstances.

Full agreement

This agreement represents the full and complete statement of the Terms and Conditions under which the Admin will accept advertising. No conditions, printed or otherwise, appearing in insertion orders, contract, insertion instructions, or any other form of correspondence that conflict with these terms and conditions will be binding on the Admin.
